Duty to Disclose: Sellers (and their agents) must disclose any defects that might affect a buyer's use and enjoyment of the property. Latent (hidden) defects that are known to the seller must be disclosed if they pose a serious risk to health and safety. Sellers cannot intentionally conceal patent defects.

Examples of required disclosures:
  • Basement leaks (seasonal or otherwise)
  • Known pest issues (termites, etc.) not treated
  • Knob and tube wiring
  • Additions built without permits
  • Illegal basement apartment (no permit)
  • Lead in drinking water
